Federal Judge Dismisses Illinois' Carry Case Moore v. Madigan

(GunReports.com) -- Federal District Judge Sue E. Meyerscough has dismissed a challenge to Illinois statutes that prohibit the carrying of loaded firearms outside the home for personal protection.
Judge Myerscough denied a preliminary injunction against two laws in Illinois that make it a crime to carry loaded firearms outside the home for personal protection. Instead, she supported the state's motion to dismiss the case.
The case of Moore v. Madigan is named for individual plaintiff Michael Moore and defendant Lisa Madigan in her capacity as Illinois Attorney General. The litigants included Moore, other private citizens Charles Hooks, Peggy Fechter, and Jon Maier, and gun-rights groups Second Amendment Foundation and Illinois Carry.
Meyerscough is an Obama administration appointee who formerly served on the Illinois State Appellate Court.
In her ruling, Judge Meyerscough wrote, "This Court finds that the Illinois 'Unlawful Use of Weapons' and 'Aggravated Unlawful Use of a Weapon' statutes do not violate Plaintiffs' Second Amendment rights. The United States Supreme Court and the Seventh Circuit have recognized only a Second Amendment core individual right to bear arms inside the home. Further, even if this Court recognized a Second Amendment right to bear arms outside of the home and an interference with that right, the statutes nonetheless survive constitutional scrutiny."
Get used to losing citizens rights, especially if you vote OBAMA back in. He has been stacking the deck with anti gun judges, including the "Supreme Court". It's simple, keep him in, LOSE your rights. I always wondered why my MI CPL makes it OK to carry in MI, IN, MO, (and most other states) but when passing thru IL, if I get stopped, I become an instant Felon. Oh, I forgot! It's The Peoples' Republik of Illinois... I'm shocked, shocked I tell you that an Obummer appointee in ILLINIOS would strike down a firearms related case of any kind. My, my, I guess I'll have to remain in the United States, here in Texas. And I was so looking forward to moving to a foriegn, socialist country like Illinois. Bummer. Illinois is the most corrupt state in the Union ( Along with Michael Bloomberg Of New York )You wouldn't want to believe anyone would have ANY-RIGHTS in the most communistic states in the USA. Vote obama back in for another term and you will know what HITLER (obama)and Germany were like!!!!!!!!!!!!!!!!We need more of a non citizen's appointees in the judgeship. Since 1998, I have avoided the state of Illinois like the plague. It was that year that I was stopped by two cops who fooled around with me for two hours while they tried to figure out what they were going to do about my car loaded with firearms and me packing concealed. I finally out-debated them, and I kept all of my property and happily left the state.....forever. I refuse to spend any money in Illinois, and I will never cross its frontier for any reason. Gotta call Bullshit on this one. The Heller decision did not as Judge Meyercough states "recognized only a Second Amendment core individual right to bear arms inside the home." It in fact identifies "such as self-defense within the home" as an example of the breadth of the Second Ammendment protection. She is either stupid (can't read properly after much education) or is effectively lying (reinterpreting under false pretense)--either of which should bring about her impeachment. We need to start removing from the bench those judges that fail in their oath to protect the Constitution. I live in Il and it's not the most corrupt state- it's Chicago and the machine that runs roughshod over the rest of us that is. Most of us are freedom loving but we have to put up with the BS legislated in the paved over upper right hand corner. jwash - I feel your pain. Many states are held hostage by their major population centers. New York and California both have very conservative bases throughout the state that are overshadowed by the concentration of urbanites dependent on the government teat. I heard in a bar somewhere that IL was going to be one of the first states with an open season on judges.... I think it was CA, NJ, NY and IL that were alleged to be considering it.... Apparently there are far too many and they're diseased and insane and causing a public menace. Or so I was told.... I understand how decent Constitution loving people may be held hostage by the large population centers of the states in which they live. That said, why can't those decent Constitution loving people develop a grass-roots political organization to overcome and overthrow the so-called ruling class? Perhaps I am sounding a bit naive, but if basic freedoms were being denied a large part of any population, it seems that same large part of the population could do something to bring about some change. Kinda sounds like 1775, doesn't it? Canovack - Because the majority aren't constitutionalists; they are dependents. Dependents of the government and its "infrastructure." Just remember November 2012 and VOTE to get O'Bama out of office, or he will make more court appointees like this judge. Image one more liberal Supreme Court justice to replace a retiring conservative justice and the 2nd amendment is toast.
