NY FFL Gets 121 Months for Straw Sales

(GunReports.com) -- A Federal Firearms Licensee named John Rumble, 56, of Ogdensburg, New York, has been sentenced to 121 months imprisonment for several federal firearms related offenses.
>[?On June 2, 2011, a U.S. District Court jury in Utica convicted Rumble of the following offenses: one count of conspiracy to make false statements in his FFL records; two counts of sale of a firearm to an illegal drug user; two counts of making false statements in his FFL records; and one count of being an unlawful drug user in possession of 150 firearms that traveled in interstate commerce.The jury also rendered a special verdict wherein they decided that Rumble must forfeit his 150 firearms to the federal government for destruction.
This investigation was initiated in the Spring of 2008 when the Saint Lawrence County Drug Task Force initiated a state court authorized wiretap on the telephone of an individual believed to be involved in drug trafficking. The wiretap investigation revealed that this individual and others were involved in the smuggling of high grade marijuana from Canada into the United States.
On October 8, 2008, a state search warrant was executed at this individuals residence. During the search warrant, officers located approximately 100 pounds of marijuana, 8 ounces of cocaine, and 72 firearms. Further investigation revealed that two of the 72 firearms traced back to Rumble.
During an audit and investigation of Rumble's FFL records, ATF discovered that RUMBLE knowingly facilitated the straw-sale of three firearms to people that were prohibited from possessing firearms by making false entries in his FFL records to hide and conceal the identity of the actual purchaser of the firearms. Throughout this entire investigation, law enforcement officers seized approximately 305 firearms.
"...forfeit his 150 firearms to the federal government for destruction." What the heck? As badly as the feds seem to need our money, why wouldn't they just put these up for auction online? They got them for free, so it's all profit to them! This is the information that I received from the BATFE notices, does anyone have the testimony or any idea of the defense made by the accused? I'd like to know if this is a legitimate prosecution or more government persecution of gun dealers. I haven't had time to look for any newspaper reports on this case, but I have to wonder if the dealer actually knew the straw buyers were making the purchases for others as straw purchasers and if the 4473s differ in any way from his bound book entries or they are basing their claim that false information was entered solely on the 4473s. This case doesn't quite pass the smell test, and Gun Walker isn't the only illegal operation the BATFE has perpetrated over the years since they were created. This needs further investigation by the Gun Press instead of being passed out as simple information of another case involving guns. I agree the firearms destruction is unwarranted as I doubt any of this dealers private collection has any post sales samples of machine guns or other destructive devices. A good collection of hunting rifles and curios and relics is more likely what will be destroyed. ATF....Always Think Forfeiture... your're right something is real stinky. This sounds like a typical ATF railroad job, need a whole lot more information. Ya gotta remember that it was ATF guys that suckered Randy Weaver into a trap, and it was also ATF guys that figured they had to raid the Mt. Carmel compound instead of just waiting for David Koresh to step off the property.....which he did quite often. Is Janet Reno back in DOJ? Did anyone else become alarmed by the "FEMA" test yesterday. I am just wondering if that is in someway enjoined with a plan to shut down communications by the government at their will. It happened in Egypt, Lybia, Iraq, etc. Am I just becoming TOO paranoid? Heck, if I was this guy's lawyer I would have been claiming links with the other straw sales through F&F. He was just assisting the feds. Let them deny it and then let a jury decide who to believe. You raise an interesting concern, Cecil. I don't know if it's paranoia, but a healthy concern about what our government is up to can't be too far from prudence. Ain't it interesting all of the words that start with the letter "p" that might apply here? Like paranoia, prepared, preposterous, prudence..... Colonel, I told a neighbor about the test and what I thought and I told him that I would bet the next step would be to do some testing with the internet service and all the social media. Later that night, I heard a little 10 second spot on one of the news channels that, yes, they are going to do that also. Sort of scary. Love, Batfe While I distrust ATF as much as the Arabs, the guy did have 100 lbs of grass (which is another topic of discussion since I am not sure that it should be on the controlled sub. list) and 7 oz of coke, so it would appear to me, without knowing the full story that something else might have been afoot. Cecil S - It's just my opinion, but when someone or some agency proves itself to be not just untrustworthy, but not worthy of ANY trust at all, I don't think you call it 'paranoia'. And once that happens, there's no such thing as 'too much' caution or healthy suspicion. That's just survival instinct. Visigoth - very interesting thought. Where would the burden of proof lie on that defense? Unfortunately, there are enough gun dealers out there who make us all look bad. We've had a few in the metro-Philly area that got busted in recent years, and they all had something else going on as well - like drugs, domestic violence, shady paperwork... P V B - I could be wrong but I think the burden of proof lies with the ATF. If the forms say the buyer is OK, and are signed, and the buyer passed the NCIS check, then the ATF would have to prove he KNEW, without any reason in the paperwork to suspect, that the buyer was a phony. I guess that's were Bloomberg's phony buyers come into the picture, huh? Paperwork? Is that anything like toilet paper? David b., I don't trust anyone in government. But then you could probably call me nuts. I am just trying to make it day to day and care for my Mom and my puppies. Oh, yeah, and the occasional water leak under the sink or the dishwasher shitting the bed and on and on. I just wish the government would quit pissing me off each and every day and devote my brain power to keeping MY things in order. Holy shit. Who, in our age group would have ever dreamed that things could be this out of control? Well, Cecil, those of us in our age group pretty much saw the handwriting on the wall back in 1973, when Nixon was forced into resigning the office. As we fast forward from there, we had some interesting scandals popping up all along the way. Nobody was really held accountable for all the screw-ups and criminal subterfuge along the way, so it's not any great wonder that we are seeing some really brazen professional crooks permeating the hallowed halls of government, today. Once again Colonel, you are dead on. And most sat on their asses and not paid attention by not reading the paper, not watching the news, just living for the moment,and just enjoyed the rock and roll and Rolexes. I, from the age of 25 or so always felt that it was going to turn to shit but was always accused of being paranoid. I think, however; the chickens may be coming home to roost. Hope you and your wife are well, Sir. Respectfully Thanks Vis! About the BAFTE destroying the guns, my friend had an SKS stolen a few years back. The BAFTE recovered it in a shipment of materials going to South America. BAFTE called him & said his gun had been recovered. He said great, what do I do to get it back? They said, you don't it's going to be destroyed. We were just letting you know that it was recovered. Figures. Government can do what it wants to do and if we don't like it, we can piss up a tree.
