SAF Files Amicus Brief in Chicago Gun Ban Challenge
November 17, 2009Printer Friendly | Email |
BELLEVUE, Wash. -- The Second Amendment Foundation has filed a brief to the United States Supreme Court in the case of McDonald v. Chicago, which challenges the constitutionality of that city's ban on handguns.
SAF is joined in the lawsuit by the Illinois State Rifle Association (ISRA) and four individual plaintiffs. They are represented by attorney Alan Gura, who successfully argued the landmark Heller case before the high court in 2008, leading to a ruling that the Second Amendment affirms and protects an individual right to keep and bear arms beyond the scope of serving in a militia.
The McDonald case not only challenges the Chicago ban, but also brings up the question of application of the right to keep and bear arms to the states through the 14th Amendment.
"Our filing today will help establish that the right to keep and bear arms is a fundamental right of American citizenship no city official can violate," Gura said.
Alan Gottlieb, SAF founder and executive vice president, added, "We brought this case because the Chicago ban has denied law-abiding citizens the exercise of a basic civil right for more than 20 years. We are delighted to bring this action with our colleagues in Illinois because this kind of onerous regulation simply cannot go unchallenged."

Oh, man! I can't wait for the results of this case to get published!
Gaviota
I hope it's in our favor Gaviota. These are lawyers after all........
Well,it's about time someone is trying to do something about these things.I read a thing that said gun related crime is down because of this gun ban. After watching the news reports from Chicago they might be right.......The animals I saw were useing sticks and clubs made of wood.No need for guns there.Oh wait, maybe if there had been a legal weapon available the boy might have been saved???
I sure hope we win this one cause with all the anti-gunners being put in place by El Pres. Obeyme, it looks like it is going to get real ruff. Because we are being hit by the real bad guys right on our own military bases also where just one ccw could have saved alot of lives. God Bless America and Our Troops Past, Present and Future Keeping to My Oath, Locked, Loaded, and Keeping My Powder Dry
All logic and rational thought, along with the success of previous related litigation, points to a decision in the favor of our Second Amendment rights. I would like to hold my breath for this, but experience tempers my optimism. I hope, and yes.....I pray, that this case is decided in favor of our cause for freedom. When (if) this Chicago thing goes our way, the skids will definitely be greased as precedent for other cases to follow. Who knows?.....We may see the dominos willingly begin to fall across the nation!
